The landlords say they had to pay to get the premises clean and for cockroach control after the tenants moved out.

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish.

It was not proved that the tenants did not leave the premises reasonably clean and tidy, or that they failed to remove their rubbish. Only one post-tenancy photograph was submitted. That showed a cockroach on a concrete floor (the carpets having been removed so that new carpets could be installed). The evidence was insufficient to meet the standard of proof on the balance of probabilities.

The tenants submitted an email dated a few days after to the to the property manager that complains of cockroaches. The tenants say the landlord never addressed the pest problem. The tenants should not have to pay for pest control when the evidence is that the pests were present at the beginning of the tenancy and the landlord failed to address the problem.

The claim that the tenants failed to meet their tenancy-end obligations is dismissed. Filing fee
