The landlord has applied for rent arrears and has provided rent records which prove the amount owing. The Tenant did not agree with this amount as she recalls making payments previously which were not recorded on the rent summary. The Tenant was not sure how much in rent arrears she was but did not agree to paying.
In considering the evidence, I find it more likely than not that the rent arrears owing were as per the rent summary provided. The Tenant did not produce any receipts, bank statements or rent summary to disprove the amount claimed.
The amount ordered is proved.
The Landlord claimed water rates arrears and provided a tenancy invoice and Watercare statements. The Tenant disputed the amount because she found a water leak at the property towards or at the end of the tenancy. The Tenant said her Case Manager advised her the water charges were quite high at one stage however when asked at what date did the water rate charges become high, the Tenant could not answer. The Tenant submitted there was also a hole in the bathroom which could be related to the leak however she had no evidence to support this.
The Landlord submitted she discovered a leak after the tenancy ended under the house when she saw a puddle outside. She organised a plumber to repair it. The Landlord did not see any leaks at the property during the tenancy and none were reported by the Tenant during the tenancy so she submitted this leak did not affect the water rates.
In considering the evidence, I find the Landlord has provided sufficient evidence to prove the amount claimed. There was nothing from the Tenant to substantiate the leak caused the water useage to increase.
The amount ordered is proved.
As Mog Limited T/A Angel Property Managers As Agent For Catherine Yutseme Harm Nam has wholly succeeded with the claim the Tenant must reimburse the filing fee.
The Tenant sought name suppression however as she has not been successful in her defence, an Order has not been granted. The Landlord has not requested name suppression.
