The tenancy of Jeeraporn Paileeklee at Unit/Flat 11D, 30 Upper Queen Street, Auckland Central, Auckland 1010 is terminated, and possession is granted to Auckland City-Living Management Limited, at 11:59pm on Wednesday 18 October 2023.
The Bond Centre is to pay the bond of $1,800.00 (3437984-016) to Auckland City-Living Management Limited immediately.

Reasons

The landlord attended the hearing. The tenant did not.
I made two attempts to contact the tenant on the mobile number provided in the tenancy agreement. The first call I left a voice message informing the tenant who I was and why I was calling and that I would call back in 10 minutes. The second call got cut off by the tenant before it could go to voice mail. I am satisfied that the tenant received proper notice of the hearing time, date and place and chose not to attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 13 September 2023 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The tenant notified the landlord on 13 June 2023 that he wanted to be released early from the fixed term tenancy, as he wanted to travel overseas for a few months. The twelve- month fixed term tenancy was not due to conclude until 13 September 2023. The landlord did not agree to the early termination of the tenancy and informed the tenant of this decision. The tenant left the premises on 17 July 2023, but the landlord expected the tenant to return to the premises after his holiday. He had not returned as at 13 September 2023 and no new tenants had moved into the premises prior to that date.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice. Filing fee Because Auckland City-Living Management Limited has wholly succeeded with the claim, I must reimburse the filing fee.
