The Bond Centre is to pay the bond of $930.00 (5640822-004) to Haven Living Management Limited immediately.
Leon Compton must pay Haven Living Management Limited as Agent for Scotch Myst Ltd $5,8948.54 (“the debt”), calculated as shown in the table below:
The debt is to be paid by monthly payments of $500.00. The first payment is to be made on 24 April 2024 and payments will continue on the fourth Wednesday of every month after that, until the debt is paid in full.
The payments are to be made by the tenant to Mr. Stuart Matthew, who will ensure that all rent moneys received by him from the tenant are immediately paid on to Haven Living Management Limited, without deduction.
If any of the payments directed in Order 3 are not made within two working days of the due date, the repayment agreement will come to an end and the whole of the remaining debt will become due and payable immediately.

Reasons

Both parties attended the hearing.
The hearing was also attended by Mr Dylan King, director of the Owner (“the company”) and by Mr Stuart Matthew, Mr King’s father.
On 9 November 2023 the Tribunal made an Order terminating the tenancy on 12 November 2023, due to the extent of the rent arrears owed.
That Order was unable to quantify the arrears accurately because: a. there was insufficient evidence to clarify what sums were owed to the tenant for work done for the company; and b. the position with the bond was not clear.
Having heard from all parties today I am satisfied that: a. the landlord’s rent records prove the amount owed to the end of the tenancy (the tenant had thought a lesser amount was owed but that was from a rent summary to the date of the last hearing and not to the end of the tenancy); and b. the sums owed to the tenant by the company are properly allowed for; and c. that although the agreement provides for a bond of $2,480.00, only $930.00 in bond was paid by the tenant and that bond has been lodged with the Bond Centre.
The tenant has been working with Mr. Matthew on arrangements to repay the debt and the repayment terms recorded above are ordered by agreement.
Because Haven Living Management Limited has succeeded with the application I must reimburse the filing fee.
