The tenancy of Elicia Cerise Irving at 6 Oxford Road, Lake Rotoma, Rotorua 3074 is terminated, and possession is granted to JVL Limited, at 11:59pm on Saturday 18 November 2023.
The date of termination in Order 1 is conditional on the tenant paying rent for the rent period 12 November 2023 to 18 November 2023 no later than 14 November 2023. If that payment is not made when due, the tenancy will end immediately, and possession must be returned to the landlord.
The Bond Centre is to pay the bond of $1,800.00 (3523429-003) to JVL Limited immediately.
Elicia Cerise Irving must pay JVL Limited $5,750.44 immediately, calculated as shown in the table below:

Reasons

The landlord attended the hearing which was held by teleconference. A Notice of Hearing for today’s teleconference was duly served on the tenant but she was unable to be contacted on the number specified in the Notice or on the number given by her in the tenancy agreement.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
Rent was at least 21 days in arrears on the date the application was filed. Section 55(1)(a) provides that I must make an Order terminating the tenancy unless, in terms of subsection (2) I am, “...satisfied that the breach has been remedied (where it is capable of remedy), the landlord has been compensated for any loss arising from the breach, and it is unlikely that the tenant will commit any further breach of a kind to which this section applies.”
The current rent arrears have been owed since 22 July 2023. Since then, the weekly rent has been paid when due and the arrears have not increased. The landlord’s evidence is that he has not been able to engage with the tenant to discuss a plan to pay the arrears and the tenant has not attended today.
That being so, there is no alternative but to make an Order terminating the tenancy, which will take effect at the end of the next rent week, provided this week’s rent is paid so the debt does not increase further.
Because JVL Limited has succeeded with the claim I must reimburse the filing fee.
