Reasons

Today’s remote hearing was held on the application of the landlord to terminate the tenancy on the basis of rent arrears. Mr Paino, the tenant’s lawyer attended as his representative as he is currently incarcerated on remand. Mr Paino confirmed that Mr Oliver Hayes is his client, and he is the same person who contracted this tenancy using the alias of Stephen Matthew Hind.

Rent was at least 21 days in arrears on the date the application was filed and is well in excess of that at today’s date. Accordingly, the tenancy is terminated 1 , effective immediately given Mr Hayes is currently in prison.

The bond is to be transferred to the landlord in part payment of the rent debt accrued to yesterday’s date given the landlord resumes possession today. The remaining sum is owed to the landlord.

Mr Paino has been extremely helpful in making arrangements for the removal of Mr Hayes’ belongings remaining at the property. Accordingly, by consent: a. Mr Paino is to liaise with the landlord and Mr Hayes’ authorised representative to collect his remaining belongings. b. All belongings inside the premise must be removed by the end of this coming Sunday. Any that are left after that time may be disposed of by the landlord. c. Mr Paino has also offered to liaise with the Police to affect the return of the key fob for the premise to the landlord who is entitled to it, effective immediately. 1 See section 55(1)(a) Residential Tenancies Act 1986. d. Mr Paino will also liaise with the Police in an effort to have Mr Hayes’ car keys released in order that his car can be removed from the premise car park.

Because Dean Alexander Bevan And Chyanne M Bevan As Trustees For The Bevan Trust Limited have wholly succeeded with the claim I must reimburse the filing fee.
