Reasons

Both parties attended the hearing remotely.
The landlord has applied for termination of the tenancy, and rent arrears.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (“RTA”).
The landlord provided rent records which prove the amount owing on 14 November 2023.
The tenant was given an extra two weeks by the landlord to remove his belongings from the premises. The landlord refused to keep helping the tenant due to stress and inconvenience caused by rent arrears. However, the landlord admits that the tenant is a nice person and believes that the government should help him instead.
The tenant did not dispute, as of 14 November 2023, the rent he owed is $11,220. He informed the landlord that he had found a full-time job and offered to work out a repayment plan. Unfortunately, the landlord still insisted on terminating the tenancy.
I told the tenant that section 55(1)(a) of the Residential Tenancies Act requires me to terminate the tenancy if the rent was, at the date of filing the application on 18 September 2023, at least 21 days in arrears. Because the landlord’s application had satisfied me that section 55(1)(a) RTA applies, I must terminate the tenancy unless the landlord agrees not to terminate. In this case, the landlord refused to accept a repayment plan from the tenant.
Accordingly, the tenancy is terminated, and possession is granted to Jeffrey Page, at 11.59 pm, Wednesday, 29 November 2023
Because Jeffrey Page has wholly succeeded with the claim I must reimburse the filing fee.
