The Bond Centre is to pay $1,567.15 from the bond of $1,760.00 (3181370- 022) to Auckland Property Management Limited As Agent For Paul Christian immediately to repay the rent arrears and filing fee to the landlord as set out in the table below.
The balance of the bond of $192.85 is to remain at the Bond Centre.
Mr Fiti will repay the outstanding bond amount of $1,567.15 by making the following payments to the landlord: a. $50.00 on Thursday, 5th October 2023; b. $50.00 on Thursday, 12th October 2023; c. $50.00 on Thursday 19th October 2023; and d. $1,417.15 on Wednesday 25th October 2023.
The Landlord will resubmit the amounts in paragraphs 3(a) to (d), in one lump sum, to the Bond Centre within 23 days of its receipt of the first payment and will hold the monies paid to it in its bond account in the interim.
Mr Fiti will also pay current rent of $440.00 each Thursday from 5th October 2023 to 26th October 2023.
If Mr Fiti fails to pay the amounts at paragraphs 3 and 4 within 2 working days of the due dates, the full amount of the outstanding bond/rent will fall due immediately, and the tenancy will be terminated.

Reasons

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears, refund of the bond and reimbursement of the filing fee.
The tenant breached his obligations by failing to pay the rent arrears owed for more than 21 days. The landlord served a 14-day notice on the tenant, but the breach was not remedied within the required period, as the tenant was overseas and was unable to make payment until he could secure funds from his KiwiSaver.
The tenant wants to repay the bond used to repay the rent arrears and filing fee to avoid immediate termination and has agreed to a bond repayment plan with the landlord that grants the landlord conditional termination of the tenancy.
The landlord has provided rent records which prove the amount owing.
Having heard the evidence, I am satisfied the parties have come to a mutually acceptable bond repayment arrangement, that Mr Fiti will pay the outstanding bond within the period specified in the order, or preferably earlier if his circumstances allow, and is unlikely to commit any further breach. As such, I have granted a conditional termination. See section 78(3) Residential Tenancies Act 1986.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
Because Auckland Property Management Limited As Agent For Paul Christian has wholly succeeded with the claim I must reimburse the filing fee
