The tenant raised two issues.
The first issue related to a failure by the landlord to maintain the furnished premises during the tenancy. That is a matter that the tenant is entitled to have considered by the Tribunal, but the tenant must first lodge a claim with the Tribunal. The tenant cannot simply make a decision to withhold rent.
The second issue related to the terms of an agreement between the parties for the tenant to receive a rent credit at the commencement of the tenancy. The tenant said that the agreement was for a two week rent credit. The landlord said that the agreement was for a one week credit. The one week credit has been applied to the rent summary provided.
There was no evidence provided to the Tribunal in support of the claim that there was to be a two week credit. The Tribunal is entitled to make inferences from the evidence placed before it, or in this case the evidence not provided. Had the tenant not received the credit at the commencement of the tenancy in November 2022, I would have assumed that there would be evidence in writing from the tenant, whether by way of email or text, of complaints that the landlord had failed to provide the full credit. No evidence of that nature was provided. In this matter, I prefer the evidence of the landlord and the tenant is ordered to pay $4,048.57 in rent arrears.
As Nzpro Property Management Ltd - Lj Hooker Mount Albert As Agent For Devid Hok has wholly succeeded with the claim I must order the tenant to reimburse the filing fee.
