Both parties attended the hearing.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
The parties signed an agreement that recorded the last day of the tenancy as 20 October 2023. On 20 October the tenants had left the city and were relying on charity to collect some furniture and other belongings they left at the tenancy premises. The belongings were not collected and the landlord has claimed rent to 6 November 2023, when the premises were empty and the keys returned to the officer.
I have considered the landlord’s submission. I find the tenancy ended on 20 October 2023. The landlord could have taken possession then and had the belongings removed and charged the tenants. Instead they chose to wait and claim rent.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The landlord has also claimed the cost of cleaning and she produced an invoice for an end of tenancy clean. The tenants said they cleaned.
The RTA does not require the premises to be provided or returned in a spotless or an immaculate condition. The standard is based on what an average bystander would consider reasonable; not on the subjective opinions of the landlord and tenant. There is no scientific way to determine what is reasonably clean and tidy, and the Tribunal must evaluate the evidence available, and in particular inspection reports and photographs.
The landlord did not provide me with any supporting information – such as the final inspection or photos. This means I cannot determine if the premises were left reasonably clean and tidy. This claim is not proved and it is dismissed.
Because the landlord has substantially succeeded with the claim I have reimbursed the filing fee.
