The tenancy of Stacy-Ann Barbara Wells at 370 Boundary Road, Willowby, RD 4, Ashburton 7774 is terminated, and possession is granted to Pgg Wrightson Real Estate Limited - Ashburton As Agent For Daphne Pringle, at 11:59pm Monday 27 November 2023.
The Bond Centre is to pay $649.01 from the bond of $1600.00 (5479617-001) to Pgg Wrightson Real Estate Limited - Ashburton As Agent For Daphne Pringle immediately.
The balance of the bond of $950.99 is to remain at the Bond Centre.
The tenant’s last-minute request for an adjournment is refused.

Reasons

The landlord attended the hearing by remote teleconference. There was no attendance by the tenant. An attempt was made to contact her on the telephone number provided however the phone call went straight to answerphone.
At 12.31pm today the tenant emailed the registry at Timaru. The registry staff did not see this email until approximately 2.20pm when it was forwarded to me. In her email the tenant requested a late adjournment of the matter stating that she would like to contest the application. She also said that she had been unable to get computer access to put in her paperwork and evidence.
I then sent an urgent email to both the registry at Timaru and our remote tenancy email address asking the tenant to urgently provide a contact number which I could call her on. Staff from Timaru and the remote team telephoned and emailed her. There was no response from the tenant to these requests. Her phone continued straight to voicemail.
The tenant’s request for an adjournment must be refused. The tenant has had plenty of advance notice of today’s hearing and should have requested an adjournment well in advance. And even though she is requesting an adjournment my view is that she can still answer her telephone.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy. The landlord also provided an updated an updated rent ledger. Having sighted both ledgers I am satisfied that the tenant is responsible for the overdue amounts.
Because Pgg Wrightson Real Estate Limited - Ashburton As Agent For Daphne Pringle has wholly succeeded with the claim I must reimburse the filing fee.
