Both parties attended the hearing.

The landlord had sought to terminate the tenancy for breaches of the tenancy agreement and Residential Tenancies Act 1986 (RTA). The specific breaches alleged were parking multiple cars on the premises, breaching quiet enjoyment of neighbours by tooting their car horns in the night, partying, loud music.

In addition, the landlord had applied for rent arrears and has provided rent records which prove the amount of $1342.86 owing as of 10 January 2024.

Evidence was heard from the tenant, a witness for the tenant and the landlord regarding these breaches. The tenant accepted that there had been breaches of the tenancy agreement but that things had improved since receiving the breach notices. The landlord acknowledged that there had been no further complaints since the notices had been sent.

During the hearing, the landlord sought an undertaking from the tenant that there would be no further breaches regarding loud music, excessive cars parked on the premises and disturbing the neighbours. The tenant gave the reassurance required by the landlord.

The landlord does not wish to proceed with their application for termination of the tenancy. Rent arrears.

The tenant accepted that she owed $1342.86 in rent arrears. She explained that her hours of work had been reduced and she had fallen behind in the rent. However, the tenant had been making regular rent payments and was wanting to enter into an agreement with the landlord to repay the rent arrears.

The landlord and tenant agreed that the rent and rent arrears will be paid as follows: a) The rent of $550.00 per week will be paid every Tuesday as required. b) From Tuesday 16 th January 2024 the tenant will pay the rent of $550.00 plus $50.00 towards the rent arrears. c) The tenant will pay $600.00 each Tuesday, (being $550.00 rent and $50.00 rent arrears) until the rent arrears are paid in full. After that, the tenant will pay the rent of $550.00 per week as required. Suppression

The landlord sought suppression of their name and details, which is not granted. The reason for the refusal to suppress details is that the parties mediated the outcome of this order and normally mediated orders are not publicised.
