Reasons

The tenant attended the hearing. The landlord did not.
I am satisfied that the tenant had received proper notice of the hearing time, date and place and chose not to attend.
The tenant’s tenancy ended on 27 October 2021. Despite numerous calls, emails and messages to the landlord, Aaron Rush and Chance Kohi have been unable to get the landlord to refund their bond to them.
The tenant gave evidence that when the tenancy first started there were four flatmates, all of which paid some money towards the bond. At the time Aaron Rush and Chance Kohi’s tenancy ended, Tom Bailey and Sarah Polford had long since left the flat and had been paid out of their share of the bond.
A month after the tenancy ended the tenant commenced the process of trying to get his $787.00 bond refunded. He and Chance Kohi completed a bond refund form with all their details contained on it and took it together to Harcourts in Glenfield. They were told to go to Albany Harcourts as this was now the branch that had been assigned that property to manage. They did not have the time or the funds to drive to Albany, so asked Glenfield branch to send the bond refund form through. That branch refused, even though it was the branch they had dealt with for the duration of their tenancy.
They contacted Jordan Western- Russell from that branch, who the tenant says has been unhelpful.
The tenant confirmed to the Tribunal: a. He has spoken to Jordan Western- Russell from Harcourts and Jordan is aware of these proceedings and has been served the tenant’s application and evidence provided to the Tribunal; b. $986.90 of the $1,950.00 bond is owed to Chance Kohi; c. $805.44 of the $1,950.00 bond is owed to Aaron Rush; and d. 157.66 of the $1,950.00 bond is owed Harcourts Albany.
I am satisfied that the amounts owing from the Bond to the three named parties is correct and instruct the Bond Centre to pay the sums set out in this Order to those parties. Reimbursement of filing fee
Because Aaron Rush has wholly succeeded with the claim I must reimburse the filing fee.
