Reasons

The landlords attended the hearing, the tenants did not attend.

The original tenancy agreement and management was with Rental 21 Limited (T/A Century 21 Dhatt & Co.) as agent for Mohammad Faiyaz Rauf. Subsequently the property management was taken over by Empower Rentals Limited as agent for Mohammad Faiyaz Rauf. Both previous and current property managers attended this hearing.

This is the second hearing of this matter, previously a case conference was held to determine the issues for the substantive hearing. One tenant appeared at that hearing and outlined a number of claims she wished to make against the landlord.

Both the landlord and the tenants have applications before the Tribunal. The hearing was schedule for the full day on 30 August 2024. The tenants were sent notices for this hearing. I am proceeding with the hearing in their absence, as I have not received an adjournment request and they have not appeared at this hearing. Tenants’ application dismissed.

The tenants did not attend the hearing at the scheduled time, request an adjournment, or notify the Tribunal the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.

I am dismissing the tenants’ applications as there was no appearance of either of them at the hearing. Landlord’s claim.

The landlord has applied for rent arrears, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.

The tenancy ended on 8 May 2024. The landlord provided rent records which prove the amount of $14290.00 owing at the end of the tenancy.

I am satisfied that the landlord has proven their claim for rent arrears. Bond

The bond is to be refunded to the new property management company, Empower Rentals Limited immediately to offset the debt owed by the tenants to the landlords. Filing fee

Because Empower Rental limited as agent for Mohammad Faiyaz Rauf has wholly succeeded with the claim I must reimburse the filing fee.
