The hearing was held by teleconference. The representative for the landlord attended the hearing. The tenant did not attend. The tenant was contacted on the contact number provided in the application, but without success.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 11 September 2023 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord received a call from the tenant’s friend (Jenny) advising that the tenant would be returning that weekend to clean out the unit and return the keys. The keys were not returned. Multiple attempts by the landlord to contact the tenant (and his friend) including visits to the tenancy address have not been successful. The landlord’s enquiries with the tenant’s neighbours revealed that he had not been seen for a number of months.
As the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.
