Ms Sahni attended the teleconference hearing on behalf of the landlord. The phone number for the tenant, the last three digits being 292, was called twice without any response.

As the landlord’s application was made more than 2 months after the end of the tenancy, the service requirements of section 91A Residential Tenancies Act 1986 (“RTA”) apply. The landlord’s application was sent by email and SMS to the tenant, which does not meet these requirements. The landlord discussed the efforts they have made to contact the tenant since the end of the tenancy. The tenancy ended due to a police raid on the property resulting in the tenant being arrested and removed by the police from the property. The landlord said the tenant had provided the name of his neighbour, who was his relative, as his emergency contact. However, this neighbour/relative of the tenant was also apparently arrested along with the tenant. The landlord said they received calls and emails from a woman claiming to be the tenant’s girlfriend, asking for a refund of the bond, and they asked her to provide contact details for the tenant, which she did not. The landlord said they also attempted to phone the tenant multiple times immediately after the end of the tenancy, without success. They have since been informed by the police that the tenant’s mobile phone was seized by them shortly after the police raid. The landlord said they are not aware of the tenant’s whereabouts but have made efforts to try and contact him.

The landlord requested an order dispensing for service. Given the evidence of the landlord’s efforts to try and ascertain the tenant’s whereabouts and the circumstances of the police raid, I find the landlord has made reasonable efforts in this regard and I order that the requirements for service on the tenant are dispensed with.

The landlord has applied for rent arrears, outgoings, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
