Reasons

Ms Schroeder attended the hearing for the landlord. The tenants did not attend.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and payment from the bond.
The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. A tenancy is abandoned where the tenant leaves the premises not intending to return or to meet their obligations.
I am satisfied that the tenants have abandoned the premises. There has been some doubt about that because the premises are occupied. It seems that the tenants have allowed others to occupy them, but it has been unclear whether that is a permanent arrangement or not. As well, rent was not in arrears when the landlord filed this application and rent has fallen into arrears only recently.
The landlord has met with the current occupiers and given them the opportunity to apply for a tenancy. They have not done taken up that opportunity. It is now clear that the tenants have left the premises permanently.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.
This is a fixed term tenancy ending on 9 June 2024. Therefore, the tenants remain liable to pay rent until either the landlord has relet the premises or the term of the tenancy has expired, whichever comes first.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
The landlord has succeeded and so the tenants must pay the filing fee.
