The landlord’s application seeks repair and rubbish removal costs.
The hearing took place in Whangarei on 24 May 2024. Ms Parese, representing Kāinga Ora, attended the hearing by phone. Ms Carlyle now resides in Auckland. The Registrar attempted to contact Ms Carlyle by phone but there was no answer. I am satisfied that notice of the hearing was served on the tenant 1 . The hearing proceeded in the absence of the tenant 2 Repairs – holes in walls
Kāinga Ora provided a copy of the final inspection report dated 24 October 2023.
The photographs show: a. Several large holes in the wall below a light switch in the kitchen / dining area. b. A large hole in the wall in the lounge, just above the skirting board. The walls in the lounge had been drawn on and the wallpaper was torn.
The damage occurred during the period of this tenancy, and the damage is beyond fair wear and tear. Tenants are liable damage that they cause, and also damage caused by anyone who is at the premises with their consent.
The cost of repairs and painting is proven. Rubbish removal
At the end of a tenancy the tenant must leave the premises reasonably clean and tidy and remove all rubbish 3 .
The final inspection report shows that the premises were left in an extremely untidy state. The house was not clean. The lawns and gardens were very overgrown. There was rubbish and abandoned belongings throughout the interior and exterior of the premises.
The abandoned belongings included large items of furniture as well as clothing, foodstuffs, and general household items.
Kāinga Ora seeks compensation for the cost of rubbish removal only, there is no claim for general cleaning or for lawn mowing.
Kāinga Ora withdrew part of its claim, for disposal of rubbish left in the lawns and under the deck.
