Order

The tenancy of Jenna Maree Floyd and Shannon Laxon at 44 Drake Crescent, Awatoto, Napier 4110 is terminated, and possession is granted to Bay Asset Management Limited immediately.
Jenna Maree Floyd and Shannon Laxon must pay Bay Asset Management Limited $6,877.58 immediately, calculated as shown in the table below:

Reasons

Only the applicant landlord attended the hearing. Neither tenant could be contacted on the telephone numbers provided. Minutes before the hearing Mr Laxon said he would provide an alternative number, but despite waiting 20 minutes for him to do that, he did not provide it either to the property manager of the Court Registry staff.
The hearing therefore proceeded in the absence of the tenants.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy. The rent has been recalculated at the original rent of $430 per weeks, as there is no ability for a landlord to increase rent without providing the proper 60 days written notice of the increase and within 12 months of the start of the tenancy or last rent increase.
The landlord checked the bank account and confirmed no rent had been paid today and no rent has been paid since a part payment was made on 10/1/2024.
The tenancy must be terminated because of the rent arrears. The only defence the tenants may have had that might change this outcome, was that they had paid all of the arrears and were unlikely to fall into arrears again. (see s55 (1) and (2) )
Because Bay Asset Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
The order is to be published as there are no grounds for suppression.
