Catrina Witehira and Phil Robinson must pay the debt of $2,965.25 to Colliers New Zealand Limited by 5pm on Tuesday 16 April 2024.
Catrina Witehira and Phil Robinson must continue to pay rent when it falls due.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenants fail to pay rent and the debt within 2 working days of the due dates: a. The tenancy at Unit/Flat A, 40 Raihara Street, Kaikohe, Kaikohe 0405 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Reasons

The landlord attended the hearing which was held by teleconference. The tenants did not attend the hearing. The tenants were contacted several times on the contact number provided in the application but without success. I proceeded with the hearing in the tenants’ absence as I was satisfied adequate service of the hearing notice had been completed.
The landlord has applied for termination of the tenancy and rent arrears.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
