The tenancy of Shanice Therese Whiu at 71 Dunbars Road, Halswell, Christchurch 8025 is terminated, and possession is granted to Accommodation Centre Limited As Agent For H Yan & D Kong, at 11:59pm on Sunday 21 April 2024.
The Bond Centre is to pay the bond of $360.00 (6257648-024) to Accommodation Centre Limited As Agent For H Yan & D Kong immediately.
Shanice Therese Whiu must pay Accommodation Centre Limited As Agent For H Yan & D Kong $800.44 immediately, calculated as shown in the table below:

Reasons

The landlord attended the hearing represented by Mr Bowden and Ms Lindsay. Ms Whiu did not attend the hearing. She was telephoned twice. The first time someone answered and then ended the call when spoken to. The second time the call rung out to Ms Whiu’s voicemail.
I am satisfied that Ms Whiu had been made aware of the hearing as she had been served with the notice of hearing and had been liaising with the landlord about it. Accordingly, the hearing proceeded in her absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. Whilst a significant amount of the arrears has been paid, there are still monies outstanding for rent and for bond. Mr Bowden also gave evidence that Work and Income New Zealand have withdrawn their support for the tenancy as Ms Whiu is no longer eligible for a tenancy with this level of rent.
Accordingly, as Ms Whiu is in arrears and there is no evidence that she is able to pay the arrears or rent going forward, pursuant to section 55(1)(a) of the Residential Tenancies Act 1986, I terminate the tenancy. I have directed that the tenancy terminate at the end of the week to enable Ms Whiu to make her arrangements.
The landlord provided rent records which prove the amount owing at the end of the tenancy.
Because Accommodation Centre Limited As Agent For H Yan & D Kong has wholly succeeded with the claim I must reimburse the filing fee.
