Reasons

Only the landlord attended the hearing, represented by Nina Maharaj. The calls placed to the tenant went to voicemail.
This is a fixed term tenancy at a rent of $750 per week. The tenancy began on 26 April 2023 and ends on 26 April 2024.
Ms Maharaj explained that the tenant’s rent was being paid by WINZ but that WINZ stopped the payments as at 10 January 2024 as the tenant had travelled overseas. The tenant returned and some effort was made to reduce the arrears but on 7 March 2024 the tenant simply emailed the landlord stating “This is to let you know that I have found a house and am giving 3 weeks notice as of today. Can you please confirm that you have received this email and respond.”
The landlord responded immediately reminding the tenant that they had entered into a fixed term contract ending on 26 April 2024 and advising that that the current rent arrears were (at that stage) $2,026.48. The landlord advised further that if the tenant did not see out the fixed term they would pursue all arrears until the end of the fixed term.
The tenant then sent a further email on 18 March 2024 simply advising that she had moved out and that the landlord could pick up the keys.

What is the status of the tenancy?

The usual legal position with a fixed-term contract is that the term of the contract will be applied strictly. Tenants are able to apply to the Tribunal for an order reducing the fixed term if there has been an unforeseen change in their circumstances (See s66 Residential Tenancies Act 1986).
The tenant has not made an application to reduce the fixed term and the landlord has not agreed to end the fixed term. The tenancy therefore remains on foot and rent continues to accrue.

How much rent is owed to date?

The landlord provided rent records showing that rent of $3,190.00 is due and owing (to the end of the current rent period to 26 March 2024). I have ordered payment of arrears in this amount.

What will happen now?

Rent will continue to accrue. Ms Maharaj explained that the landlord is considering their position going forward. It may be that they can reach an agreement with the tenant whereby the fixed term ends early subject to the tenant meeting the rent until the start of the new tenancy.
Ms Maharaj also explained that the landlord is likely to claim further compensation for cleaning and damage. If so, these claims will form a new application (likely including any further arrears). Filing fee and name suppression
Because Mpg Limited has substantially succeeded with the claim I have reimbursed the filing fee.
No orders for name suppression were sought.
