Maneea-Sue Walters and Nevaeh Walters must pay Landed Property Management Limited T/A Harcourts Landed As Agent For Waipukurau Trust $3,220.44 immediately, as calculated below:

Reasons

Both parties attended the hearing, the tenants being represented by Maneea- Sue Walters and her mother.
The parties had signed a 12-month fixed term tenancy agreement to commence on 16 February 2024. It was on a standard form and recorded the weekly rent was to be $800.00.
Ms Walters had been living in another property managed by the landlord (Property 1). That tenancy had terminated as a result of the landlord giving 90 days’ notice. There had been no difficulty with her payment of rent.
As the end of that tenancy drew near, the tenant was desperate for somewhere to live. The landlord had this property available, 2D Melleray Place (Property 2) but it was more expensive than the existing tenancy. The property managers managed to get the rent reduced but it was still a more expensive property. The tenant had hoped that her brother would move in with her to help with the rent. She also wanted to transfer the bond from the first property, but the property manager told her she would need to pay the new bond first. When the tenant phoned Tenancy Services she was told that the first bond, for Property 1, had not been lodged.
Based on documents produced by the landlord at the hearing, I am satisfied that the landlord had lodged the bond for Property 1, but that it has not been allocated to the tenant’s tenancy.
It became too difficult for the tenant to move in. Believing that she was not bound by the agreement because she had not paid the bond, on 16 February 2024, the tenant notified the landlord that she was unable to afford the tenancy and she would not be moving in.
The owner agreed to reduce the fixed-term to a periodic tenancy and sought four weeks’ rent in lieu of notice.
I find that the tenants are bound by the agreement that she signed. They are liable to pay the rent specified in the tenancy agreement. If the landlord had tried to pull out of the agreement on 16 February, I would have made the same ruling that they were bound by the agreement.
The landlord has been reasonable in seeking only 28 days’ rent and I order the tenants to pay that, which is $3,200.00.
Because Landed Property Management Limited T/A Harcourts Landed As Agent For Waipukurau Trust has wholly succeeded with the claim I must reimburse the filing fee.
