Sharee Tohilima and Ibby Litaio must pay Gralin Property Management (Auckland Central) Limited as Agent for Sujuan Shang $1,204.43 from the bond, calculated as shown in the table below:
The Bond Centre is to pay the bond of $2,720.00 (3421375-005) immediately apportioned as follows: Gralin Property Management (Auckland Central) Limited as Agent for Sujuan Shang: $1,204.43 Sharee Tohilima and Ibby Litaio: $1,515.57

Reasons

Both parties attended the hearing, which was held by telephone.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records and water rates invoices which prove the amount owing at the end of the tenancy.
The amounts sought were largely agreed by the tenant, except that she questioned the water invoices as the landlord is completing a new build on the site behind her property and using the water from the premises.
The landlord accepted that water was used for construction until the water was connected to the new site in January 2024. The landlord paid the full water invoices for October and November 2023 to account for this. The tenant paid the water invoice for December.
Considering the provisions of s39 of the Act, I consider the water invoice for December should be the landlord’s responsibility. Accordingly, I have deducted that from the amount sought.
I consider the amounts ordered are proved.
Because Gralin Property Management (Auckland Central) Limited as Agent for Sujuan Shang has wholly succeeded with the claim I must reimburse the filing fee.
