Aukuso Tafau and Sevia Iefata owes Tbt Property Management Limited $2,480.44 (“the debt”) in accordance with the following table:
Aukuso Tafau and Sevia Iefata must pay rent and the debt as follows: a. By a payment of $2,480.44 for the debt on or before Thursday 25 April 2024. b. A payment of $630.00 for rent on or before Friday 26 April 2024.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenants fail to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 130 Tennessee Avenue, Mangere East, Auckland 2024 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

The landlord attended the hearing represented by Mr Singh. The tenants did not attend the video conference, nor did they answer the calls made to their phone. As they had been served with the notice of hearing, the hearing went ahead in their absence.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986. The tenants were in 21 days arrears when the application was filed and are still in 21 days arrears today although they have made some payments towards the debt.
The landlord is prepared to give the tenants an opportunity to pay the debt in order to keep the tenancy. Accordingly, as sought I have granted a conditional termination order.
The conditional termination order will lapse if it is fully complied with. If the tenant breaches the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
Because Tbt Property Management Limited has wholly succeeded with the claim I must reimburse the filing fee.
