On 23 February 2024 the Tribunal made an order terminating this tenancy due to rent arrears 1 .
This application seeks compensation for cleaning, rubbish removal and change of locks, and general compensation for stress.
The hearing took place on 19 July 2024. 1 Just Listed Ltd v Raharaha & Taite [2024] 4797457
Ms Anderson represented the landlord at the hearing. There was no appearance by the tenants.
This was a brief and unsuccessful tenancy, beginning in December 2023 and ending by termination in February 2024.
Tenants must leave the premises reasonably clean and tidy and remove all rubbish at the end of the tenancy. Tenants must also return all keys. 2
Ms Anderson provided photographs showing the condition of the premises at the end of this tenancy.
The premises were in an unclean and tidy state. There was a substantial amount of rubbish left behind.
The owners carried out the cleaning and rubbish removal themselves.
The owners are entitled to reasonable compensation for their work. They provided a detailed summary of their time and work, which included flea treatment and steam cleaning of the carpet (the tenants kept a dog at the premises, in breach of the terms of the tenancy agreement).
The locks were changed by Northland Locksmiths at a cost of $156.80 (invoice provided).
The landlords also seek compensation of $2,000.00 for stress / “emotional harm”. I was provided with a statement from the owners detailing the undeniably unpleasant experience that they endured during and at the end of this tenancy. The owners certainly experienced stress as a consequence of the tenants’ behaviour.
However, there is no legal basis in the Residential Tenancies Act 1986 for the Tenancy Tribunal to award damages to landlords for emotional distress. Therefore, this part of the claim must be dismissed.
