Reasons

Both parties attended the hearing by video. The tenants were represented by their son, Mr Esmael.

The tenants applied for refund of the bond.

The landlord applied for compensation for cleaning and refund of the bond.

Did the tenant comply with their obligations at the end of the tenancy?

At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.

The tenant did not leave the premises reasonably clean and tidy.

The landlord produced photographs from before the tenancy began and after it ended. Some parts of the premises were reasonably clean but some cleaning was still required including windowsills, doors, the rangehood, and some drawers.

The landlord had offered to cover half of the cleaning cost. This was not accepted by the tenant.

One issue that the tenant had was that they were not given an opportunity to clean the premises after the landlord raised issues from the final inspection.

The law does not require a landlord to give a tenant a second opportunity to clean after an inspection. Sometimes this opportunity is given to tenants, but it is not required.

On the evidence I am satisfied that the tenants should be liable for half the cleaning cost, and this is ordered.

As both parties have applied to the Tribunal and had some success, I make no award for reimbursement of the filing fee.
