Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 11 March 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord had tried to contact the tenants and had been unable to contact them. When he went to the premises, the house looked abandoned from the outside.

During the hearing, Mr Snow confirmed: a. He came home one night in February 2024 to find Ms Williams had left with her belongings and he has been unable to contact her since; b. He was unable to afford the rent on his own and has fallen into rent arrears as a consequence; c. He packed up the house and left the premises on 20 February 2024, but has not returned the keys and Ms Williams took her set of keys to the premises with her; d. He was stressed about the circumstances he found himself in and did not think to contact the property manager on the date he abandoned the premises; e. He understood that the tenancy was a fixed term tenancy that ends on 8 December 2024 and that he and Ms Williams remain liable for the rent to the date of the expiry of the term or the date of commencement of a new tenancy of the premises, whichever is the earlier; and f. He understood that because neither he or Ms Williams had let the property manager know they had abandoned the tenancy, the landlord has been unable to start advertising for a new tenant for the property.

Because the premises have been abandoned, and rent is in arrears, the tenancy is terminated immediately.

The landlord provided rent records which prove the amount owing to 1 April 2024. The rent still needs to be paid until a new tenant moves into the property. Reimbursement of filing fee
