Both parties attended the hearing, conducted via video/tele conference. Areena Deshpande represented her mother, Christine. They confirmed they represented all tenants.
The landlord has applied for termination of the tenancy, compensation, water rates, rent arrears and refund of the bond.
The claim for water rates was withdrawn as the final amount owing may reduce further due to pending credit because of a water leak.
The owners are in short-term accommodation as they have been unable to move in on 1 May 2024 as expected. This move in expectation was based on a prior notice to terminate. There were some drafting errors in that notice but given the termination here is made for rent arrears it has not been determined if that order would stand. Regardless, the claims of $500.00 a week for accommodation is offset by the rent due here and no actual loss has been established. That claim is dismissed. The reliance on subsequent recovery of the rent due is acknowledged. If possession does not return to the landlord quickly a future claim for such a loss after today may be made.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing at the end of the tenancy is $12,448.10.
