Reasons

Both parties attended the hearing which was conducted remotely.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
In a decision dated 21 March 2024 in proceedings numbered 4759378, the Tribunal declared that there was a tenancy between the landlord and tenant from 5 November 2023. An order was made for rent arrears of $12420.00 which covered 18 weeks’ rent from 5 November 2023 to 22 March 2024.
At today’s hearing the tenant acknowledged that she has made no payments towards the arrears or paid any current rent since the order was made. She said that she did not know the bank account. I do not accept that is a valid reason for not paying rent. She has had ample opportunity to ensure the rent was paid. She has now lived there rent-free for 5 ½ months.
The tenant disputed that the weekly rental is $690.00, however that is the amount showing on the original tenancy agreement and in the rent summary that was available at the last hearing. I am satisfied that is the correct amount.
The tenant disputed the bond, saying that she paid two bonds. She also raised complaints about the owner, who originally managed the property. She is entitled to pursue those matters through her own application to the tenancy.
I have allowed the tenant a few more days to vacate the tenancy. The tenancy is terminated and possession granted to the landlord at 4pm on Sunday 21 April 2024. She must pay the further arrears plus the rent up to and including 21 April, which comes to $3,055.71.
Because the landlord has been wholly successful, I must reimburse the filing fee of $20.44.
