Yvette Michelle Joy must pay Prestige Real Estate International Limited $4,187.58 immediately, calculated as shown in the table below:

Reasons

Mr Harris and Mr Blair attended the teleconference hearing on behalf of the landlord. The phone number for the tenant, the last three digits being 966, was called twice without any response. As the tenant was served, the hearing proceeded in her absence.
The landlord has applied for termination of the tenancy, rent arrears, outoings and refund of the application fee.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlord provided rent records which prove the amount owing to 7 May 2024, which is $3,960.00. Weekly rent is $725.00 so daily rent is $103.57. A further 2 days’ rent @ $103.57/day is payable for 8 May 2024 to 9 May 2024, for a sub-total of $207.14. Therefore, the tenant owes the landlord a total of $4,167.14 in rent to 9 May 2024, which is the end of the tenancy.
The landlord claimed $394.81 for water charges owing, which they said was up to whenever the tenants left the property. The only ledger provided by the landlord dedicated only to water charges went to 7 February 2024, but had a zero arrears balance as at that date. Other ledgers provided mixed rent and water charges or were general office ledgers indicating total amounts owed for water. The landlord only provided two water invoices, for the period 8 January 2024 to 7 February 2024 (the amount of this invoice did not match what the landlord was charging the tenant for water for this period however) and from 7 February 2024 to 6 March 2024. Given the evidence provided, I am not satisfied that the landlord has provided sufficient evidence to prove their water claim and so this claim is dismissed.
Because Prestige Real Estate International Limited has been successful with the claim I must reimburse the filing fee.
