Caoimhe Barker and Denis Irvine attended the video hearing.
Both CB and DI have applied to the Tribunal to resolve a dispute over part of the bond. This was a joint tenancy with four tenants that ended on 9 March 2024.
The landlord says that the bathroom vanity top was damaged during the tenancy. He thinks it was burned or melted by hair straighteners. He supplied a photo.
The landlord has had the vanity top repaired at a cost of $295.00.
One of the other tenants has authorised the refund of the bond of $2,000.00 to the landlord. He has received this.
The landlord says that he has returned $1,500.00 to the other three tenants. He says that there is $205.00 remaining from the bond to be paid to CB.
CB agrees that the damage to the vanity happened during the tenancy. However, she says that she contributed $500.00 to the bond and thinks that the landlord should refund her $426.25 because the $295.00 repair cost should be shared equally between the four tenants ($73.75 each).
CB says that she did not cause the damage and that the four tenants have not agreed who did cause it. My decision
The other three tenants do not have a dispute with the landlord, so I have removed their names from the proceedings.
I agree that the landlord has a right to compensation for the cost to repair the vanity top because it was damaged during the tenancy. The repair cost is reasonable.
The four tenants are jointly and severally liable to the landlord which means that the landlord can choose which of them he seeks compensation from.
The landlord has chosen to return $1,500.00 of the bond money to the other three tenants. He said that he has done this because, based on what he knows of what happened, he thinks it is most likely that CB caused the damage to the vanity.
The landlord may or may not be correct about that. However, in law, he has the right to choose.
The landlord has been successful in showing he had an entitlement to compensation for the repair to the vanity, so I award him the filing fee.
The balance to be returned to CB is $184.56.
No suppression orders are sought.
