Larissa Lee Townsend must pay the debt in full by no later than Wednesday 15 May 2024.
Larissa Lee Townsend must also pay the usual rent of $580.00 per week. The next rent payment will be made tomorrow, 23 April 2024, and payments will continue every Wednesday thereafter.
If the tenant fails to pay rent and rent arrears on the due dates: a. The tenancy at Unit/Flat A, 666 Te Ngae Road, Owhata, Rotorua 3010 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.
The conditional termination order lapses once the arrears are paid in full

Reasons

The application seeks termination of the tenancy and rent arrears.
The hearing took place by phone today. Both parties attended the hearing. Ms Knowles represented the landlord.
Ms Townsend does not dispute the amount of the arrears, which covers the period from 11 March 2024 to today’s date. The owner waived all previous rent arrears.
Ms Townsend submitted that she is willing and able to seek assistance from WINZ to clear the arrears in full, but the landlord did not provide her with a letter to enable her to do this.
Ms Townsend stopped paying the rent due to this and some other minor irritations. That was a poor decision.
The landlord has grounds for termination of the tenancy due to the amount of the arrears.
Rather than make an order for immediate termination, I am willing to give Ms Townsend the opportunity to pay the arrears and get the tenancy ‘back on track’.
Ms Townsend will: a. Reinstate her weekly rent payments, beginning tomorrow. b. Make arrangements to pay the arrears in full. I have given Ms Townsend a period of three weeks to do this.
If Ms Townsend does not meet either of those conditions, the landlord will terminate the tenancy.
The landlord has been successful in this application and I will also award the landlord the filing fee of $20.44.
