The landlord attended the hearing today.
The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
I note that the bond is held by the Bond Centre in the name of Rental 21. I am satisfied that there has been a change of landlord and that the bond should be refunded to New Age Rentals Limited as agent for the owner. I have joined New Age Rentals to the proceeding in place of the previous property managers. Rent and Water
The landlord became aware that the tenant had left the property, without returning the keys, on 26 May 2024. Treating this either as the tenant’s 28-day “notice” or as abandonment under section 61 of the Residential Tenancies Act 1986, the tenant is liable for rent until about 23 June 2024. The premises were rented out again from 3 June 2024 to new tenants. It follows that the landlord is entitled to rent to 2 June 2024.
The rent arrears to 2 June 2024, as shown on the landlord’s rent summary, are $9,780.00. The landlord also provided a water summary showing a small amount owed for water charges. Repairs and rubbish removal
At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit.
A landlord must prove that damage to the premises occurred during the tenancy and is more than fair wear and tear. If this is established, to avoid liability, the tenant must prove they did not carelessly or intentionally cause or permit the damage. Tenants are liable for the actions of people at the premises with their permission.
Where the damage is caused carelessly, and is covered by the landlord's insurance, the tenant's liability is limited to the lesser of the insurance excess or 4 weeks' rent. The weekly rent was $620.00, and the insurance excess was $1,000.00.
Tenants are liable for the cost of repairing damage that is intentional or which results from any activity at the premises that is an imprisonable offence.
The ingoing inspection report for the new tenant dated 3 June 2024 identified broken windows in a bedroom and the toilet, 2 holes in the wall requiring filling and sealing, and marks on the walls and doors.
