Reasons

The landlord attended the hearing. The tenants did not attend.
Ms Hopkins-Rae contacted the registry this morning to request a telephone attendance. She provided the number for the Tribunal to call her on. The registrar tried calling her 3 times and the other tenant once. None of the calls was answered.
The landlord applied to terminate the tenancy for abandonment by the tenants. The landlord cannot be sure whether the tenants have abandoned the tenancy or not.
The tenancy is a fixed term tenancy that ends on 5 June 2024.
The landlord has other grounds on which to terminate the tenancy.
Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986 (RTA).
The landlord provided rent records which prove the amount of rent owing as of today.
Because it is probable that the tenants are no longer residing at the premises, I have granted the landlord possession today.
The landlord could also have applied to terminate the tenancy on the grounds of breach of the tenants’ obligations (the failure to pay rent) for which 14-day breach notices were issued by the landlord. The breach was not remedied.
The landlord did not seek a refund of the bond. However, she has another Tribunal application yet to be heard so she can seek the bond then. She can also amend that application to include water rates and any costs that arise once she has possession of the premises.
As the application is successful, the tenants must pay the landlord’s Tribunal filing fee.
The landlord sought, and is entitled to, a name suppression order on the successful application – see section 95A RTA.
Because the tenants did not attend the hearing at the scheduled time, I have dismissed their application.
