Raylene Ruka owes Gerard Patrick Smyth $870.44 (“the debt”) as calculated in the table below.

Raylene Ruka agrees to pay rent and the debt as follows: a. By fortnightly payments of $1470.00, being $1300.00 for rent and $170.00 for the debt. b. Payments will be every fortnight, with the first payment on Friday 28 June 2024 and continuing every fortnight Friday until the debt is cleared .

Payments will be allocated in the following order: rent, rent arrears, and the filing fee.

If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at 219 Kilmore Street, Christchurch Central, Christchurch 8011 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

If the tenant fails to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

The parties agree that the final date of the tenancy will be Friday 30 August 2024.

The parties also agree that if the tenant wishes to leave earlier than 30 August 2024 then she is to give 14 days’ notice of termination of her tenancy to the landlord.

Raylene Ruka agrees that if the tenancy ends early, as described above, then then any arrears still owing will be paid by vacate date.

This agreement is in full and final settlement of this claim.

Reasons

Both parties attended the hearing by phone. I note that the previous adjudicator allowed Craig Henare to represent Raylene Ruka but at today’s hearing Ms Ruka advised that she did not need or wish Mr Henare to represent her.

The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination. Agreed Settlement

At today’s hearing it was apparent that the landlord and the tenant had discussed what should happen in relation to this tenancy. Both parties were fully on board with the settlement as described in the Order above and I consider it to be a reasonable settlement in these circumstances.

I note that while the arrears currently amount to $850.00, I have added the $20.44 filing fee to the debt because if a party is wholly successful in their claim then the other party must reimburse them the filing fee. C ter Haar 25 June 2024
