This application was scheduled to be heard by teleconference. My calls to the number provided for the tenant did not go through and so the hearing proceeded in his absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, payment of the bond and reimbursement of the filing fee.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 12 April 2024 the landlord became aware that the tenancy had been abandoned when they went to deliver a 14 day notice to remedy rent arrears and found that the premises were empty.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing. The amount ordered includes rent in lieu of notice. This was calculated as being 28 days from the date that the property was found abandoned – that is, rent is owed until 10 May 2024 which is 28 days from 12 April 2024.
