Reasons

Only the applicants attended the hearing which took place by teleconference. The tenant was called on the number provided but the calls went to answerphone. The file records that the tenant was sent notice of today’s hearing.
The landlord has applied for termination of the tenancy, rent arrears and reimbursement of the filing fee.
Rent was at least 21 days in arrears on the date the application was filed. The arrears have increased, and the landlord seeks termination of the tenancy as the tenancy has not responded to attempts to resolve this matter. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
The landlords have applied for rent arrears and provided rent records which prove the amount owing at the end of the tenancy in the sum of $12,200.00.
The landlords explained that this is a deceased estate. Sadly, the owner passed away and in December 2023 the tenant was sent notice of the change of ownership to the trustees and the new account to pay rent to. Since then, the tenant has paid amounts totalling $3100.00 into the old account which is currently frozen until the estate is finalised. The landlords have deducted this amount from the rent sought and are seeking an order for payment of the balance owed being, $9100.00.
Because Dr Sarah Baker and Amanda Rutherford as Trustees for the Le Prou Trust have wholly succeeded with the claim I must reimburse the filing fee.
