Stacey Taiapo must pay Oaks Property Management Limited as agent for Sri Property Investment Ltd $1,220.19 immediately on the basis of the table below:

Reasons

Only the landlord attended the hearing, represented by Mr Wright. I made two attempts to call the tenant on the numbers provided but both numbers appeared to be disconnected. I am satisfied that the landlord’s application has been served in accordance with the applicable service provisions under the Residential Tenancies Act 1986 (“RTA”) and so the hearing proceeded in the tenant’s absence.
The tenancy began on 6 October 2022. The landlord advised that the tenant has not been paying water rates as they fall due which has caused there to now be substantial water arrears.
The landlord provided copies of all invoices and a ledger which shows that a lump sum was paid on 24 April 2023 (clearing water arrears owing at that date) and that after that time the tenant has been paying $30 per week towards water. However the weekly amount is not sufficient to cover the water used and so every month there is a shortfall. The outstanding balance is currently $1,199.75.
The landlord issued a 14 day notice on 2 May 2024 and that notice has not been remedied.
The landlord advised at the hearing today that they are happy to continue with the tenancy as long as the current water arrears are paid. I have therefore not made an order for termination of the tenancy. However the tenant should be aware that if the water arrears are not paid and the arrears continue to accumulate the landlord may apply again to the Tribunal for an order terminating the tenancy.
It may be sensible for the tenant to increase the weekly amount paid for water so that this situation does not continue to arise. Mr Wright advised that he intends to discuss with the tenant to see whether a new arrangement can be agreed. Mr Wright is also going to deliver a copy of this order to the tenant to ensure that she receives a copy.
As the landlord has been substantially successful I have refunded the filing fee.
