Reasons

Mr Balsdon attended the hearing remotely as the landlord's agent.
The tenant, Mr Owen, did not attend the hearing. I called Mr Owen’s cell number listed on the landlord’s application for termination twice. Both calls went to the voicemail system straightaway without ringing.
Mr Balsdon said Mr Owen might have been taken into custody. He could not verify the information. However, Mr Balsdon said the property is occupied by people who are not the tenants in the tenancy agreement. The newly installed carpet at the start of the tenancy has been damaged.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
Mr Balsdon is seeking immediate termination of the tenancy. Bond
Mr. Balsdon informed me that the bond was sent to the Bond Centre on 15 April 2024. However, their system shows no record of the Bond Centre sending him a bond lodgement confirmation.
Mr. Balsdon was certain that the bond ($2,000) was indeed sent to the Bond Centre.
Mr. Balsdon can contact the Bond Centre to arrange the bond's refund.

Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
