The landlord’s property manager attended the hearing by telephone. The tenant did not attend and a call to her last known number went to voicemail.
The landlord has applied for termination of the tenancy for abandonment, rent arrears and refund of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 29 July 2024 the landlord’s agent became aware (or ought to have been aware) that the tenant had abandoned the premises (the Date of Abandonment). The property manager gave evidence that she attended the property on 29 July 2024 for the purpose of inspecting it, and found the house unlocked. The property manager said, unlike other times she had visited, there were no perishable food items present, and it appeared the tenant had removed most personal items. Furniture was still present, but it was in chaos.
The property manager emailed the tenant the same day to state they considered the property abandoned. After receiving no response from the tenant, on 1 August 2024, the property manager arranged to have the locks changed. On 2 August 2024, the property was re-let to new tenants.
As the landlord regained possession of the premises on 1 August 2024, there is no need to order termination.

How much does the tenant owe?

A tenant who abandons the premises shall be liable to pay the rent for any period up to and including but not after the date of the expiry of the period of 28 days after the Date of Abandonment, or, the date of commencement of a new tenancy at the premises. See section 61(3) Residential Tenancies Act 1986.
The premises were re-let from 2 August 2024. The landlord provided rent records which prove the amount owing to 1 August 2024. The amount ordered includes rent in lieu of notice. Water rates
The landlord’s agent withdrew the application for outgoings (water rates). The landlord’s agent indicated a subsequent application for damages is likely to be made and any claim for water rates, including supporting evidence, may be filed with that application.
