Santana Murtagh and Shilo Wilson must pay Motueka Real Estate Limited T/A Corinthian Property Managment As Agent For Edward Cowley $3,723.92 immediately, calculated as shown in table below:
The Bond Centre is to pay the bond of $2,360.00 (6479707-006) to Motueka Real Estate Limited T/A Corinthian Property Managment As Agent For Edward Cowley immediately.

Reasons

The landlord attended the hearing, conducted via teleconference. Two calls to the tenant went unanswered. I was satisfied adequate service had completed and I continued with the hearing after the second call also went unanswered.
The landlord had applied for termination but now sought possession of the premises following the early termination of the tenancy by the tenant, rent arrears, and water rates.
The landlord provided a rent summary and water invoices that established the amount ordered here.
The tenancy ended on 6 June 2024 after the tenant notice to quit. This is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 (“RTA”) are satisfied. If necessary, rent at that time was more than 21 days in arrears and a termination per s 55(1) RTA would have been made.
The intentions of Ms Murtagh after giving notice was uncertain to the landlord and the landlord believes she may have remained at the premises after 6 June 2024 with the intention of the tenancy continuing. The landlord has a possession order and may enforce it or enter into a new tenancy agreement with her as it sees fit. It is appropriate to end this tenancy given the two named tenants.
Section 60(1) RTA states that where a tenant remains in occupation of the premises after the tenancy has terminated or has been terminated, all the obligations of the tenant shall continue in force as if the tenancy were still subsisting until such time as the tenant ceases to occupy the premises.
Because Motueka Real Estate Limited T/A Corinthian Property Managment As Agent For Edward Cowley has wholly succeeded with the claim I must reimburse the filing fee.
