Sharahon Mahanga and Georgina Mahanga owes Raewyn Karen Jeanette Cole $1,970.44 (“the debt”), calculated as set out in the table below:
Sharahon Mahanga and Georgina Mahanga must pay rent and the debt as follows: a. Weekly rent of $650.00 must be paid in full and on time each week; b. The rent arrears of $1,950.00 must be paid in full on 6 August 2024; and c. The filing fee of $20.44 must be paid on 6 August 2024.
All payments made will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenants fail to pay $650.00 rent each week on the due date for the next 2 weeks or fail to pay the $1,970.44 debt within 2 working days of 6 August 2024: a. The tenancy at 146 Opawa Road, Opawa, Christchurch 8023 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Both parties attended the hearing.
The landlord has applied for termination of the tenancy, rent arrears and refund of the bond. The tenant wants to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
The landlord has proven the tenant were in 21 days rent arrears at the date she made the application to the Tribunal for termination of the tenancy ad possession.
The landlord confirmed she had received a call from one of the tenant’s case manager, and the tenant confirmed her case manager has told her that WINZ will provide her with 4 weeks rent arrears support when she provides WINZ with a copy of this Order. The tenant has confirmed she will pay the additional week’s rent arrears herself.
I am satisfied the tenants will pay the debt within the period specified in the Order and are unlikely to commit any further relevant breaches of their tenancy agreement as I can see from the rent summary records that for the past 7 weeks the rent has been paid in full and on time. I have granted a conditional termination order.
The conditional termination order will lapse if it is fully complied with. If the tenants breach the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Reimbursement of the filing fee
Because Raewyn Karen Jeanette Cole has wholly succeeded with the claim I must reimburse the filing fee.
