Reasons

Both parties attended the hearing.
The landlord’s agent has applied for termination of the tenancy, rent arrears, outgoings (water rates) and refund of the bond. Rent
The landlord provided rent records which prove the amount owing in rent arrears to today’s date. The tenant has not paid any rent in nearly two months and has been in arrears since 22 April 2024.
The tenant accepted the landlord’s record of rent arrears is accurate. The tenant sought further time to attempt to come up with a payment plan to pay down those debts, however, the landlord stated previous attempts to seek assistance from Work and Income had not been successful, and the amount of debt had become unsustainable for the landlord. The landlord’s agent confirmed he was seeking immediate termination.
Given rent was at least 21 days in arrears on the date the application, the tenancy is terminated. See section 55(1)(a) of the Residential Tenancies Act 1986. As the tenant indicated he and his wife have a significant amount of personal property and pets to move, the date of termination is set at 5pm on Saturday 19 July 2024 to allow them some time to make arrangements. Water rates
The landlord provided water rate records which prove the amount owing to today’s date. The tenant accepted the amount owing for water rates is correct. An order is made accordingly. Tenant’s claims raised at hearing
The tenant stated that while he accepted the amounts owed in rent and water rates, he wished to raise issues with the condition of the property and lack of maintenance. The tenant handed up (via his mobile phone) photographs of the property, including in the bathroom, which the tenant said was leaking and mouldy. The landlord viewed the photographs and stated maintenance had been carried out when requested, but that he did not have the appropriate records with him and was concerned that any further delay will only increase the amount of rent arrears. The landlord also pointed out that the tenancy began on 29 December 2018, and therefore, the Healthy Homes Standards do not apply.
The landlord has applied for termination on the basis the rent is more than 21 days in arrears. Those arrears and water rates are not disputed by the tenant. The tenant’s maintenance issues were only raised during the hearing. I can only determine the application that is before me. If the tenant considers he has claims against the landlord in respect of the condition of the property, he is free to make a separate application to the Tribunal to seek compensation. Reimbursement of filing fee
Given the landlord’s agent has succeeded with the claim, the tenant must reimburse the filing fee.
