This hearing was scheduled to be heard by teleconference. Both times I rang the number provided for the tenant my call went to voicemail and so I proceeded with the hearing in her absence.
The landlord has applied for termination of the tenancy for abandonment, rent arrears, reimbursement of the filing fee and payment of the bond.

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrear at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.
On 4 July 2024 the landlord became aware that the tenant had abandoned the premises when she went to the address to conduct a routine inspection. The landlord found that all the furniture had gone and there was no one at home.
Because the premises have been abandoned, and rent is in arrear, the tenancy is terminated immediately.

How much does the tenant owe?

The landlord provided rent records which prove the amount owing at the end of the tenancy. The amount ordered includes rent in lieu of notice – that is, the landlord is entitled to 28 days’ rent from 4 July 2024 when the property was found abandoned.
I note that two payments of $510.00 each were made after the premises had been abandoned.
Further to this, because Riverlands Real Estate Limited As Agent For Kin Yeoh has wholly succeeded with the claim I must order the tenant to reimburse them the filing fee. C ter Haar 13 August 2024
