Delia loane, Nikolai loane, Ellamer Hikitagaloa loane, Katu Mohetaue loane and Ivah loane must pay rent and the debt as follows: a. By making one payment of $1,592.86 on Friday 2 August 2024, being $1,300.00 for rent and $292.86 for the debt. b. By making fortnightly payments of $1,500.00 thereafter, being $1,300.00 for rent and $200.00 for the debt. These payments will begin on Friday 16 August 2024 and will continue to be made every second Friday thereafter until the whole of the debt is cleared.
Payments will be allocated in the following order: rent, rent arrears, and the filing fee.
If the tenants fail to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at Unit/Flat A, 14 Blythe Place, Glendene, Auckland 0602 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
If the tenants fail to pay the filing fee within 2 working days of the due date, the filing fee will be payable immediately.

Reasons

This hearing was scheduled to be heard by video conference. The landlord attended by video link and Delia Ioane attended by phone. She advised that she had the authority to represent all the tenants named above.
The landlord has applied for termination of the tenancy, rent arrears, outstanding water rates, reimbursement of the filing fee and payment of the bond. The tenants want to repay the debt to avoid immediate termination.

Should a conditional termination order be made?

Where rent is at least 21 days in arrears on the date the application was filed, the Tribunal must make either a final or a conditional termination order. See section 55(1)(a) and (1A) Residential Tenancies Act 1986.
After discussion at today’s hearing I am satisfied the tenants will pay the debt within the period specified in the order and that they are unlikely to commit any further relevant breach. I have therefore granted a conditional termination order.
The conditional termination order will lapse if it is fully complied with. If the tenants breach the order, the possession order may be enforced for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986.
I note that as well as paying rent arrears and outstanding water charges, the tenants are required to reimburse the filing fee to the landlord because the landlord was wholly successful in this claim against them. C ter Haar 24 July 2024
