Reasons

The landlord attended the hearing, the tenant did not attend. A short while before the commencement of the hearing the tenant contacted the Tribunal seeking an adjournment. The tenant had advised the landlord that she was living overseas for a short while to care for an ill relative. The tenant had spoken to the landlord about getting her mother to attend the hearing on her behalf. The tenant did not advise the Tribunal of this nor seek approval for a representative to appear for her.
I would have rung the mother despite not having it approved through the correct channels, however the tenant stated in her email this afternoon that her mother is not available today.
This matter has been scheduled for hearing for some time now. The tenant has taken no steps prior to this afternoon to seek alternative representation. The tenant seeks an adjournment as she said the property was not in good condition and wants a rent reduction from the rent arrears.
The tenant has not filed an application seeking a rent deduction and claiming the property is not healthy homes compliant. I could not consider these claims without an application and supporting documentation. Furthermore, the landlord must be given sufficient notice of claims well in advance of a hearing.
In these circumstances I am declining the adjournment and proceeding with the hearing.
The landlord has applied for rent arrears and has provided rent records which prove the amount of 2211.43 owing at the end of the tenancy on 4 July 2024.
I am satisfied that the landlord has proven her claim for rent arrears.
The bond centre is to refund the bond to the landlord immediately to offset the debt owed by the tenant to the landlord for rent arrears.
The tenant has the remaining sum of $791.87 owing for rent arrears and reimbursement of the filing fee, which is due immediately.
Because Irelands Real Estate Limited has wholly succeeded with the claim I must reimburse the filing fee.
