Reasons

The landlord attended the hearing. Priscilla Pai attended the hearing. Antony Pai and Magdalene Pai were unavailable. Priscilla Pai advised the Tribunal that she had authority to speak on behalf of all the tenants.
The landlord has applied for rent arrears and has provided rent records which prove the amount owing.
The landlord has applied for outstanding water rates and has provided invoices from the water rates authority which prove the amount owing.
At the hearing, Ms Pai advised the Tribunal that the reason the water rates invoice dated 12 June 2024 was very high was because there was a problem with a leaking toilet. She advised the Tribunal that this issue was raised with the landlord almost immediately after the tenancy commenced on 4 December 2023 and the landlord only fixed it in June 2024. The Tribunal allowed Ms Pai some time to locate a copy of the email she said she sent to the landlord advising him of the problem. Ms Pai was unable to do this.
The landlord advised the Tribunal that the toilet was fixed in June 2024, approximately one month after the issue was raised by the tenant. The landlord submitted that the water rates invoice dated 12 June 2024 was high because it was an actual water meter reading, whereas previous invoices were estimates. The landlord submitted that this was most likely the reason for the one-off, high water rates invoice.
Both parties accept there was a problem with a leaking toilet. The tenant was unable to provide any evidence confirming that the issue was raised with the landlord in early December 2023. The landlord accepts that it took them approximately one month to fix the toilet.
I accept the landlord’s submission that it is common for a water rates invoice following an actual water meter reading to be high after the commencement of a new tenancy. This is particularly the case where previous water rates invoices have been estimates. Nonetheless, it cannot be denied that the leaking toilet, which the landlord accepts took them approximately one month to fix, contributed towards an increase in water usage by the tenant during this period through no fault of their own. It is for this reason that I have reduced the amount the tenant is to pay for outstanding water rates by $100.00.
Ms Pai raised a number of issues regarding maintenance of the property at the hearing. The Tribunal declined to hear this, as no cross-application was filed by the tenant. If the tenant wishes the Tribunal to consider these matters, they can lodge an application with the Tribunal.
Because Barfoot & Thompson Limited has substantially succeeded with the claim I have reimbursed the filing fee.
