The tenancy of Kapuakore Ngarimu at 8 Reuben Avenue, Rolleston, Rolleston 7615 is terminated, and possession is granted to My Property Manager Limited As Agent For Anupbir Kaur, at 9:00am, Monday 19 August 2024.
Kapuakore Ngarimu must pay My Property Manager Limited As Agent For Anupbir Kaur $2,727.00 immediately, being rent arrears to 15 August 2024.

Reasons

The landlord attended the hearing. The tenant did not.
There are two people listed on the tenancy agreement, the tenant and her mother. The tenant’s mother attended the hearing and advised the Tribunal that she gave notice to the landlord on 21 November 2022 that she would not be continuing as a tenant at the end of the fixed term on 9 February 2023, but that her daughter (the current tenant) would be. The landlord accepted this, but never completed a change of tenant form. I find that the tenancy agreement was varied by consent on 21 November 2022 and Kapuakor Ngarimu has been the sole tenant of the property since 9 February 2023.
The landlord has applied for termination of the tenancy for breach of the tenant’s obligations, rent arrears and refund of the bond.

Where a landlord applies to terminate for breach, and rent is at least 21 days in arrears on the hearing date, the Tribunal must terminate the tenancy. See sections 55 and 56(2) Residential Tenancies Act 1986.

The landlord provided rent records which prove the amount owing at 15 August 2024. The landlord did not provide a rent summary which showed the arrears owing at the date of the hearing on 16 August 2024. Therefore, I have only ordered arrears up to 15 August 2024.
Because My Property Manager Limited As Agent For Anupbir Kaur has wholly succeeded with the claim I must reimburse the filing fee.
