How much is owed for rent?

The tenant signed the tenancy agreement on 23 June 2024 and the tenancy was to start on 5 July 2024.
The bond amount was $2,400.00. Shortly after signing the agreement the tenant became aware that Work and Income would not pay the bond and while she had some discussions with the landlord about this, she gave written notice to end the tenancy on 3 July 2024 by text message.
The Residential Tenancies Act 1986 (RTA) applies. Section 51 (2B) of the RTA states a tenant may terminate a periodic tenancy in any case by giving at least 28 days’ notice. The final date of the tenancy is therefore 31 July 2024.
The landlord provided rent records which prove the amount owing at the end of the tenancy is $2,400.00, however I have calculated the rent arrears on the basis the tenancy was to commence on 5 July 2024 and had not commenced when the tenant gave notice on 3 July 2024.
The tenant opposed the making of the rent arrears order. I consider the tenant freely entered into the tenancy agreement and understood her obligations under the agreement. I also consider the landlord took all reasonable steps to mitigate their loss by attempting to get a new tenant within the notice period, however they were unable to do so until 1 August 2024.

FILING FEE

Because the landlord has wholly succeeded with the claim I must reimburse the filing fee.

SUPPRESSION

The landlord did not seek suppression.
The tenant applied for a name suppression which was not opposed by the landlord due however having regard to the interests of the parties and the public interest I do not order name suppression for the tenant.
